NAR® Settles Lawsuit and Real Estate Changes Effective 8/17/24

In March 2024, the National Association of REALTORS® (NAR®) settled an antitrust lawsuit with groups of home sellers and agreed to new rules regarding real estate commissions.

The new rules went into effect on August 17, 2024.

The fact is, nothing changed except for the requirement to enter into a written agreement with your Agent prior to viewing homes. Agents for decades have been presenting their clients with the "Exclusive Right to Represent" Buyer's Agency Agreement.

The reason behind the requirement is to have full transparency between a Buyer and their Agent about who pays the commission.

Our commission is typically paid by the seller, but if not, we’ll discuss how it will be covered. This is all negotiable, and we’re here to make sure it works for you.

We may work with other buyers interested in similar properties, but our goal is to get the best outcome for you.

HOW BUYER AGENT COMPENSATION IS PAID

There are three ways that a Buyer's Agent is paid.

1.

We will always negotiate for the Seller to pay the Buyer's Agent commission.

2.

In the event the Seller refuses to pay the Buyer's Agent commission, the Buyer would be responsible for the compensation at closing.

3.

Buyer brokerage compensation is paid through a combination of negotiated compensation and the remaining amount is paid for by the buyer at closing.
